Welcome to SpotQRCode. These Terms of Service ("Terms") govern your access to and use of the SpotQRCode website at spotqrcode.comand all related services (collectively, the "Service") provided by SpotQRCode ("we", "our", or "us").
By accessing or using the Service, you confirm that you are at least 16 years old, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
1. Accounts
To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@spotqrcode.com if you become aware of any unauthorised use of your account.
2. Acceptable Use
You agree not to use the Service to:
- Generate or distribute QR codes containing malware, phishing links, or illegal content
- Violate any applicable local, national, or international law or regulation
- Infringe the intellectual property rights of any third party
- Harass, abuse, threaten, or harm any person
- Send unsolicited communications (spam)
- Attempt to reverse engineer, copy, or replicate the Service
- Use automated bots or scrapers without our prior written consent
- Resell or sublicense access to the Service without our written permission
We reserve the right to suspend or terminate accounts that violate these provisions, with or without notice.
3. Payment & Subscriptions
Paid plans are billed in advance on a monthly or annual basis. All prices are in USD unless stated otherwise. By providing a payment method, you authorise us to charge the applicable fees.
- Free Trial: Where offered, a free trial automatically converts to a paid subscription at the end of the trial period unless cancelled.
- Upgrades & Downgrades: Plan changes take effect immediately and are prorated.
- Refunds: We offer a 14-day money-back guarantee on all new paid subscriptions. No refunds are issued after 14 days except as required by law.
- Cancellation: You may cancel at any time via your account settings. Access continues until the end of the current billing period.
4. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of SpotQRCode. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.
You retain ownership of any content you upload to or create through the Service. By using the Service, you grant us a limited, non-exclusive licence to host, store, and display your content solely to provide the Service to you.
5. Availability & Modifications
We aim to maintain 99.9% uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPOTQRCODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts of India.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or by displaying a notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
